The Left Should Be SO PISSED OFF!

Iraq's democratically elected parliament recently ratified a security pact between the US and Iraq that will leave US troops in Iraq for at least another three years. The development makes me, a devout supporter of the War in Iraq, very happy. Had I voted for Obama, however, I suspect I would very angry right now. Obama either expressly or implicitly promised his supporters an immediate end to the war in Iraq. Yeah, Obama may say that he never said he would immediately withdraw all the troops and that he only promised to "start" withdrawing troops within a certain number of months. But this is nothing more than Clintonesque "definition of is is" stuff. Obama's rhetoric made his supporters believe that, among other Messianic miracles, the war would end immediately should Obama be elected. Well now Obama has been elected and he will not end the war. It will continue for at least another three years. We will be on the eve of the next presidential election in which Obama will likely be a contender before a new security pact will be considered. Obama will surely insist that he has no choice but to abide by the security pact executed by his predecessor. But give me a break. President-elect Obama will soon be President Obama with the power to end the war if he chooses. Leftists! You have been misled! And all this right-winger can say is...HA!

Most Lawyers Are Dumber Than You Think

Last time I checked, workers' compensation was the exclusive remedy for employees injured or killed in the course of employment in New York State. This little fact has gone unmentioned by the media's legal pundits since a Wal-Mart employee was trampled to death On Black Friday while manning the doors of a Wal-Mart outside of New York City. The media has been dying for the decedent's family to sue and now the family has filed . But the lawsuit must be thrown out! The family's only recourse against Wal-Mart is vis-a-vis New York's workers' compensation system which caps employer liability. Just goes to show that the media knows little about what it reports. And the legal pundits are the worst. These are flashy supposedly highly experienced attorneys commenting on the legal issues of the day, yet not one of them knows that the family's lawsuit against Wal-Mart is barred. And yes, I'm talking to you Fox News!!

So here's the upshot from a real life lawyer. Workers and their families have no right to sue their employer for job-related injury or death. In this case, the family's sole recourse against Wal-Mart is through the no-fault workers' compensation system. The family is likely entitled to a capped death benefit. The family may sue third-party tort-feasors such as the local police department, the property owner (if other than Wal-Mart), on-site independent security firms and the customers that actually did the trampling. But Wal-Mart is off-limits. I wonder if the lawyer who brought suit on behalf of the family even realizes that his big lawsuit against Wal-Mart is about to be tossed!

Two Words That Shouldn't Go Together: "German" and "Army"

The German government has determined that its soldiers in Afghanistan are too fat and drunk. That only compounds the German's refusal to actually fire a weapon in Afghanistan. Maybe we shouldn't be in such a rush to whip the German army into shape. Remember what happened the last two times the Germans had an effective fighting force? Let 'em drink and eat sausages.

Is the Versatility of a Law Degree Just a Myth?

I agree with this assessment 100%! A law degree offers no versatility AT ALL! Besides that the law degree is totally wothless with respect to the pursuit of a "non-traditional career" a law license is so jusridiction specific that it becomes virtually impossible to move around the country. Those of us who attended second tier lawschools are often stuck in the designated regions that our "regional lawschools" serve! Next, law school teaches nothing about the actual practice of law so it becomes too easy to become pigeon-holed in a specific practice area. Then conflict issues often keep practitioners from even moving from one firm to another within a given field and geographic area or law firms become nasty and vindictive when associates try to leave. Although the law has given me a career I often consider the decision to attend law school one of the worst of my life primarily because of the total lack of versatility the degree offers.
